Terms & Conditions

 

These Terms & Conditions govern the sale of artworks offered by Aakriti Art Gallery / Chisel Crafts Private Limited through the website.

 

1. Definitions

                •             Buyer: Any user purchasing an artwork through the website

                •             Artwork: Any painting, sculpture, or object offered for sale

                •             Description: Details of the artwork including artist, title, medium, dimensions, year, and related information

 

2. Pricing & Taxes

                •             All prices are listed in INR

                •             Prices are exclusive of:

                •             applicable taxes

                •             shipping, packing, and insurance

                •             duties (where applicable)

 

All such charges are the responsibility of the Buyer.

 

3. Orders & Acceptance

                •             Placing an order constitutes a binding commitment to purchase

                •             The gallery reserves the right to:

                •             accept or decline any order

                •             cancel an order prior to delivery, if required

 

4. Payment Terms

                •             Full payment must be completed within 2 working days of placing the order, unless otherwise agreed

                •             Failure to make payment within this period may result in:

                •             cancellation of the order

                •             release of the artwork for sale

 

The gallery may, at its discretion:

                •             hold the artwork temporarily

                •             apply storage or insurance charges

 

5. Availability & Location of Artwork

                •             Artworks may not always be in the physical possession of the gallery

                •             They may be located with artists, collectors, or institutions

 

The gallery reserves the right to:

                •             correct errors in description or pricing

                •             cancel orders in case of discrepancies

 

6. Delivery & Collection

                •             Delivery will be arranged only after:

                •             full payment is received

                •             required documentation is completed

                •             Buyers may:

                •             opt for shipping (through third-party providers), or

                •             collect the artwork directly from the gallery

 

If collected:

 

The artwork must be collected within two weeks of payment, failing which storage and insurance charges may apply.

 

7. Shipping Responsibility

 

Shipping is handled through third-party providers.

 

Aakriti Art Gallery’s responsibility ceases once the artwork is handed over to the shipping agent.

 

8. Authenticity

 

All artworks are supported by:

                •             artist certification, or

                •             gallery assurance

 

to the best of available knowledge and documentation.

 

9. Condition & Viewing

                •             Condition reports are available upon request

                •             These are based on:

                •             artist / consignor information

                •             visual inspection

 

The gallery is not liable for subjective expectations of condition.

 

10. Buyer Obligations

 

The Buyer agrees that:

                •             All information provided is accurate

                •             Payment details are valid

                •             All applicable charges (including taxes and duties) will be paid

 

11. Registration & Account

 

The gallery reserves the right to:

                •             verify user information

                •             suspend or cancel accounts if data is found inaccurate

 

12. Refund Policy

 

Domestic Sales

 

Refunds may be considered only if:

                •             the artwork significantly differs from the description, or

                •             undisclosed damage is identified

 

Conditions:

                •             The Buyer must notify the gallery immediately

                •             The artwork must be returned within 15 days from invoice date

 

 

International Sales

 

All international sales are final and non-refundable.

 

13. Limitation of Liability

 

The gallery shall not be liable for:

                •             errors in website content

                •             delays due to third-party services

                •             indirect or consequential losses

 

14. Governing Law

 

These Terms are governed by the laws of India, with jurisdiction in Kolkata.

These Terms should be read along with:

                •             Privacy Policy

                •             Shipping & Payment Policy
